As part of the Thai government’s effort to attract international film companies, Ministerial Regulation No. 387, issued by Ministry of Finance, which was published in the Government Gazette on 3 February 2023 and will come into effect approximately six months from that date (early in August 2023), grants foreign actors working on films shot in Thailand an exemption from personal income tax for five years. The production of the film must be authorized under the relevant laws and regulations.
Generally, foreign actors filming in Thailand are subject to Thai personal income tax rates of up to 35% (or 10% withholding tax as a final tax if certain conditions are met). While the income received by foreign actors after the effective date will be exempt from Thai personal income tax, any income received by foreign actors prior to the effective date will still be subject to Thai personal income tax under the general tax rules.
