Work Permits for Newly Established Companies

After obtaining the work permit, the expatriate shall apply for the one year visa extension.

According to the Regulation of Immigration Bureau, the minimum ratio between Thai employees and foreign employees is 4:1 (this is shown on the monthly withholding tax return (“PND1”) and SorPorSor1-10 form) for supporting the application for a one year visa extension.

In addition to the above Regulation, the Labour Department considered to add an additional condition on the rear of the work permit for the first time work permit of a newly established company that the expatriate must also present the SorPorSor1-10 form showing the minimum ratio of Thai employees to foreign employees of 4:1 on the date of applying his/her work permit renewal in the next year.

Furthermore, the newly established company cannot select the other option i.e. apply for a new Non-Immigrant “B” visa to renew his/her work permit. In this case, the newly established company must employ Thai employees according to the condition as prescribed on the expatriate’s work permit for supporting the work permit renewal procedure and consideration by the Labour Department.
