Adjustment of compensation for loss of earnings after the end of the incapacity for work resulting from accidents at work

Effective from 1.6.2022, Government Decree No. 138/2022 Coll. of 18 May 2022 regulates:

• Compensation for the loss of earnings after the end of the incapacity for work incurred by an accident at work or occupational disease pertaining to the employees pursuant to Act No. 262/2006 Coll., the Labour Code, or according to Act No. 65/1965 Coll., the Labour Code so that: the average earnings determined for the calculation of the compensation for the loss of earnings or increased according to the implementing employment regulations issued for the implementation of Act No. 262/2006 Coll. and Act No. 65/1965 Coll. and according to Act No. 297/1991 Coll., on the Adjustment of the Compensation for a Loss of Earnings after the End of an Incapacity for Work Resulting from an Accident at Work or Occupational Disease shall be increased by 8.2%.
• Compensation for the costs of the maintenance of survivors pursuant to Act No. 262/2006 Coll. or pursuant to Act No. 65/1965 Coll., so that: the average earnings decisive for the calculation of the compensation for the maintenance of survivors or increased pursuant to the implementing labour regulations issued for the implementation of Act No. 262/2006 Coll. and Act No. 65/1965 Coll. are increased by 8.2%.

The compensation for the loss of earnings under the new government decree shall be applicable from 1 June 2022, provided that the right to such compensation arose before that date. The regulation of the compensation shall be made even if this right arises in the period from 1 June 2022 to 31 December 2022.
