Extended Privacy Notice

Clients, Prospects, former Clients and Collaborators, former Collaborators, Candidates, Applicants and Petitioners 

In accordance with the Federal Law on the Protection of Personal Data Held by Individuals (the "Law" or "LFPDPPP"), its Rules, the Guidelines of the Privacy Notice, and specifically in compliance with the Principle of Disclosure, Mazars Auditores, S. de R.L. de C.V., its subsidiaries and affiliates, Mazars, S. de R.L. de C.V., Mazars Consultores, S. de R.L. de C.V., Mazars Noretse, S. de R.L. de C.V. and Mazars Mexicali, S. de R.L. de C.V. (hereinafter, collectively the "Forvis Mazars Group"), makes this Extended Privacy Notice available to inform you about the processing (collection, disclosure, storage, use, transfer or disposal) of your personal data that are within our reasonable scope of control and decision.

For the purposes of this notice all references to “you”, “the owner of the data” and other similar terms shall refer to the titleholder of the data that provides personal data to the Forvis Mazars Group hereunder.

For the purposes of this Privacy Notice, any reference to the "Responsible Party" shall mean the Forvis Mazars Group.

The Forvis Mazars Group indicates that its address, for the purposes of this Notice, is: Av. Paseo de la Reforma 295 piso 8, Colonia Cuauhtémoc, Delegación Cuauhtémoc, C.P. 06500, Mexico City.

This Notice will be used by the Responsible Party in its capacity as provider of audit, consulting, public accounting, finance, information systems, and/or control services and in general any services related to the management and administration of companies, businesses, and all types of public and private entities and/or as an employer, as the case may be, who acts as the Responsible Party for the information provided.

1. Personal data we process

The personal data that you freely and voluntarily, in your capacity as Client, Prospect, former Client and Collaborator, former Collaborator, Candidate, Applicant and Petitioner provide or have provided to the Responsible Party, or any data that may come into our possession through them by listing you as a personal or work reference, or as a contact in a certain position within a company, may include but are not limited to the following:

(a) General Identification and Personal Data such as your full name, handwritten signature, RFC, CURP, age, driver's license number, Passport number, Social Security number, place and date of birth, nationality, the license plates of your car, marital status, etc.

(b)  Contact details, such as your address, email, landline, cell phone.

(c)  Patrimonial or financial data        , such as your history before government institutions such as the SAT, IMSS, and others; as well as bank account data and insurance policies.

The personal data that we may require from you, according to the classification above, may vary depending on your capacity, position, and responsibilities; or on your progress in the supplier selection processes, on your selection as a potential customer with the services of the Responsible Party or your selection as a collaborator for any subsidiary of the Forvis Mazars Group. We are committed to safeguarding any personal and business data that is shared using the strictest security measures and in full compliance with any provisions prescribed by law.

For the purposes of corroborating the veracity of any personal data you provide us, we may require you to provide simple copies or request the original of: your official photograph ID and fingerprint, bank account statement, proof of address, RFC, SAT certificate and official records issued by the competent authorities, such as powers of the legal representative, letter of employer affiliation, among other applicable supporting documents.

(d)Image, during any visit to our facilities, recorded on closed circuit video recording systems for the purpose of enforcing safety rules, procedures, and protocols within the facilities of the Forvis Mazars Group and thus prevent and/or help prevent the commission of any illegal conduct or behaviour that may threaten your safety within our facilities.

2. Use of personal data

The personal data that we process is exclusively in accordance with the following considerations:

  1. Primary or Necessary Purposes: those that give rise to or are necessary for the achievement of actions or activities between you as the owner and the Responsible party, depending on your capacity and relationship with the Responsible party, that is, for the purposes of (a) identification and full corroboration of your identity and information; (b) incorporation and updating, where appropriate, into databases and computer systems; (c) the creation and administration of physical or digital records; (d)  for the provision of audit, consulting, public accounting, finance, information systems, and/or control services and in general any services related to the management and administration of companies, businesses and all types of public and private entities (e) ;  to maintain operational and financial information about you or your company that allows us to fulfil the activities listed in the service agreement; (f) to contact you to carry out the procedures for your incorporation as a service provider; (g) to comply with any applicable laws or requirements of any competent authority; (h) to identify you using closed circuit, electronic and other systems, for the purpose of enforcing our internal security policies and procedures when you are in our facilities through the recording of closed circuit video by Forvis Mazars  (i) where appropriate, for the performance of any activity aimed at hiring you as a supplier, contractor or employee of the Forvis Mazars Group that include: (i) management of hiring procedures, registrations, cancellations, transfers, disabilities, retirements, among other activities inherent to the employment relationship, as the case may be; (ii) to contact you to carry out the interview, recruitment and selection procedures for vacancies, in person or through our internet portal: https://www.mazarscareers.com/mx/;(iii)  for the preparation of letters or records in the terms that you indicate in writing according to internal policies; (iv)  to provide you any benefits that may correspond to you as a result of our employment agreement with you; (v) to make payments, deductions and discounts from payroll, benefits, loans, advances, travel expenses bonds, insurance, savings or investment funds, and other benefits, provided that it is applicable in accordance with the terms and conditions of your contract;(vi) to carry out internal investigations or procedures in response to any complaints, breaches or misconduct under the internal regulations (vii) to carry out migration procedures; (viii) to carry out mandatory procedures on your behalf before local or federal public agencies, such as: the SAT, INFONAVIT, IMSS, the Ministry of Labor and Social Security, among others; (ix) to develop security and monitoring procedures with electronic devices to protect the physical and patrimonial integrity of people and property; (x) to comply with applicable legislation or at the request of a competent authority.;
  2. Secondary or Non-Necessary Purposes: being those that do not address the employment relationship with you or the procedure in which you voluntarily participate with us, that is, for the purposes of: (a) advertising and offer of services offered by us or by our network of global firms; (b) know your customer history with us by saving the information in our database.

2.1 If you wish to deny your consent for the Secondary Purposes

3. Sharing Information

The Responsible Party may share your personal data with subsidiary and affiliated parent companies located in Mexico and abroad and that comply with applicable privacy policies and regulations depending on the country in question, under this Privacy Notice. Likewise, the Responsible Party may disclose your personal data to comply with any applicable laws or the requirements of the competent authorities; considering:

5. ARCO Rights Requests

You, as the owner of the personal data under our reasonable control, have the right to know what personal data we have and the conditions under which they are processed (Access).You also have the right to request the correction or updating of your personal information (Rectification);that we delete it from our records or databases if you consider that the processing is inadequate (Cancellation); and to oppose its use for specific purposes (Opposition). The foregoing, by submitting a form that we will provide to you for this purpose upon request and that must be sent with the relevant documents to our Personal Data Office, or via email (except for the delivery of response to right of access requests, which can only be delivered personally and directly with the owner or their legal representative).

In addition to the handwritten signature of the owner or his legal representative, the circumstances that gave rise to your request must be clearly and precisely established, as well as any elements required to exercise of your right, for example: (i) the documents that prove your identity or, where appropriate, your power of legal representation; (ii) the description of the personal data in respect of which you wish to exercise your right, among others; Once we have admitted your request, you will receive an identification file number to receive the relevant response within 20 (twenty) business days via any channel indicated by you in your request.

In the absence of a response to your request, you may initiate the Procedure for the Protection of ARCO Rights before the Federal Institute for Access to Information and Protection of Personal Data (IFAI), located at Insurgentes Sur No. 3211 Col. Insurgentes Cuicuilco, Delegación Coyoacán, C.P. 04530, Distrito Federal, in accordance with any requirements that are notified to you for that purpose.

If you subsequently decide to revoke your consent to the processing of your personal data and, to the extent it is provided for by the LFPDPPP and any complementary laws, you may do so by sending an email to our Personal Data Office indicating your full name, contact details and the details of the revocation you are requesting and we will respond to you by the same channel.

6. Changes to the Privacy Notice

This Privacy Notice may be amended at any time. In the event of any substantial or relevant change to this Privacy Notice, the corresponding information will be available on our Internet portal  www.forvismazars.com/mx/es or on any other public media we may use to inform you.
