Latest relevant changes in Mexico on green taxes

Recently, in Mexico, legislative reforms which consider new contributions focused on environmental care have been carried out. Below are the generalities of such contributions that respond to the collection capacity of the states, as well as the federal entities in which they are applicable.

The initiatives completed by each federal entity consider the creation of a tax for individuals and legal entities that carry out activities with a negative impact on the environment. The states that have created these taxes focus on the emission of polluting gases, the discharge of polluting solid waste and wastewater into the soil and subsoil.

Regarding these three environmental consequences (emission of polluting gases, discharge of polluting solid waste and wastewater into the soil and subsoil). Although Tamaulipas and Zacatecas were the first states to impose these taxes, a significant number of federal entities are currently considering them. Among these entities, it stands out that Guanajuato is exempt of the contribution related to the polluting gases emission for the year 2023.

Therefore, it is important to carry out an analysis of the operations completed by each taxpayer, including their state branches, to determine if they generate any of the contributions listed in the downloadable document. Additionally, in order to determine the collection base, it is necessary to have adequate emission measurements.
