Deadline for tourism service platforms to remove operators that do not comply with the RNT

Initially, Law 2068 of 2020 granted a term of twelve (12) months from its entry into force for electronic or digital platforms of tourism services to remove or eliminate and not publish advertisements and/or offers of tourism service providers that do not have active and current registration in the National Tourism Registry -RNT-. However, given the delay in its regulation, Decree 1386 of 2021 extended such term until August 24, 2022.

Decree 1836 of December 24th, 2021

The Ministry of Commerce, Industry and Tourism issued this Decree, which among its provisions defines the category of electronic or digital platforms for tourism services and establishes new obligations regarding the National Tourism Registry.

Electronic or digital platforms for tourism services

Platforms that allow tourists to search and find a tourist service in their travel destination, contact the service provider, book and/or pay for the service. They intermediate between the tourist and the service provider and charge a commission, remuneration or usage fee to the provider or the tourist or both.

Special obligations of the operator of electronic platforms

This Decree reiterates the obligation for electronic or digital platforms of tourism services not to publish, remove or delete advertisements and/or offers of tourism service providers that do not have active and current registration in the National Tourism Registry or when requested by the inspection, surveillance, and control authorities. In order to comply with this provision, the platforms must interoperate with the National Tourism Registry by making available the RNT number and the URL of the advertisement of the tourist service provider so that the competent authority may verify whether the providers with advertisements on the platform have an active registration in this registry.
